Please read this carefully. By using or submitting an order (and any subsequent orders) on this web site you are agreeing to the terms that appear below.

To register with and shop with GoodnessDirect.co.uk you must be eighteen years of age or over.

1. PURCHASE CONTRACT

This website is operated by Goodness Direct, a trading division of Goodness Foods Ltd. ("we", "us" or "our"). By using the GoodnessDirect.co.uk website you are bound by these Terms & Conditions. All use and purchases made on this website are governed by these Terms & Conditions at any time although the Terms & Conditions governing any given use or purchase will be those in effect at the date of your order or specific use. If you use or order goods after we have published any changes you will be bound by those changes. Accordingly, you should check prior to each use or order to ensure that you understand the precise Terms & Conditions applicable to your site visit or purchase. To assist you in determining whether the Terms & Conditions have changed since your most recent order we will display the date when these Terms & Conditions were most recently updated.

We will confirm your order. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the e-mail address you have provided to us.

Please note that the order confirmation does not constitute our acceptance of your order. Subject to our cancellation rights, acceptance of your order and completion of the contract will take place when we despatch the goods to you.

You must be 18 years old or over and must have completed the registration process in order to participate in our service.

2. PRICE, DELIVERY AND CHARGES

The price of goods will be as quoted on the website at the time you confirm your order (usually by clicking the "checkout" button) subject only to any inadvertent technical error for which we will not be liable. Where a substitute item is offered in place of an item ordered, the price charged for that substitute item (if accepted) will be the price applicable at the time the item is substituted. Please note that as promotions are offered for a limited period of time subsequent amendments to your order may mean that certain promotions are no longer being offered.

The prices stated on the website will be inclusive of any VAT payable.

Each order you make may include a charge for packaging and delivery. If your delivery is subject to such charge, it will be shown to you as a separate charge on your order.

Orders will be despatched within 3 working days by next day courier or Royal Mail, whichever is more suitable. In the unlikely event that an order is lost, damaged, delayed or faulty we won't be able to cover for any damages or losses beyond that of replacing the goods. Please let us know of any problem, as soon as you become concerned and within 5 days of delivery for damage or faulty goods. Allow a few extra days for overseas, highlands and islands.

UK, Europe and beyond

We deliver within the European Union. Orders from outside the European Union may be possible. Please contact us if you would like to know if we can deliver to your region or country.

3. METHODS OF PAYMENT

We accept Visa (including Electron), Mastercard, Delta, Switch, PayPal and JCB cards.

We also accept payment by Goodness Direct Vouchers. No other vouchers or "money off" coupons will be accepted towards payment of an order. Any refunds arising from an order paid for by vouchers shall be given in Goodness Direct vouchers. You cannot pay for your order by cash or cheque.

Authority for payment will be requested from your card issuer between the time of your order being placed and when it is delivered. This is done by 'reserving' against the card you have used for payment. The amount that is ‘reserved’ will either be the estimated amount of your order or £1. That amount is not spent by you until we 'debit' your card with the full price of your order when we have delivered your shopping to you. We reserve the right to cancel your order if we are refused authority for payment or reasonably believe that payment will be refused at any stage.

Products are subject to availability and prevailing market conditions. We may limit the quantities of goods (particularly goods on special offer) supplied to any one customer if in our opinion the quantity ordered jeopardises availability for other customers. In the event of non-availability of any goods you order, we may offer a reasonable substitute. This may affect the price you pay. You may reject any substitute item and we will refund the amount you have been charged for that substitute. It is our policy to identify any substitute items to you at the time of delivery and give you the opportunity to accept or reject the item at that time.

We will always try to supply you with the full quantity that you have ordered. If you are not satisfied with the quantity you have received we will arrange with you for non-perishable goods to be returned to us (please note that the goods must not be used and must be in good condition). In the event that the goods delivered to you are incomplete or include incorrect goods, you must notify us promptly.

Please note adverse weather conditions or other events outside of our reasonable control may result in the occasional late or cancelled delivery. If that is the case we will endeavour to contact you as soon as we are able to in order to reschedule your delivery time and date. In any event our liability to you will be limited to the price of goods not delivered and the cost of delivery.

Should you fail to be present for your delivery we are entitled to charge you in full for an amount equal to the price of perishable items contained in your order and the cost of delivery.

4. DEFECTIVE GOODS

We advise that you inspect the goods promptly and notify us of any defects promptly after delivery. If you discover a product is faulty, please call our Customer Service team as soon as possible on 01327 701579 or email info@GoodnessDirect.co.uk.

5. OUT OF STOCKS

If an item is not in stock when we process your order we will process the remaining items so that we get your order to you as soon as possible. We will only hold your order if specific items are not in stock if you specify this when you place your order.

7. WARRANTY AND LIABILITY

We will not be deemed to be in breach of contract or of these Terms & Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.

Our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.

8. PRIVACY

We respect your privacy. The personal information that you give us is held with care and security. We do not sell, rent or transfer this information to third parties for their marketing purposes unless you agree otherwise.

You will need a password in order to shop from GoodnessDirect.co.uk. Please keep this secret, as you are entirely responsible if you do not maintain the confidentiality of your password. You are entirely responsible for all orders placed with us or information given to us under your e-mail address in combination with your password. You must immediately notify us of any unauthorised use of your e-mail address and/or password or any breach of security known to you.

9. SPECIAL OFFERS PROMOTIONS AND COMPETITIONS

With so many special offers, discounts and promotions on the go, Goodness Direct frequently issues voucher codes to help make your healthy shopping even better value. Sometimes these are vouchers giving a special deal of specific products and others are "off order" discounts. We can only accept one voucher code per order.

From time to time, and in our complete discretion, purchases of goods may be subject to special offers. In the event that such a special offer applies to your purchase, the terms of such special offer shall be subject to these Terms & Conditions. If there is any conflict between the terms of a special offer and these Terms & Conditions, these Terms & Conditions shall prevail unless specifically excluded.

We may change the terms of special offers, or withdraw them altogether, at any time and without prior notice. We will honour at the offer price any order placed by you before an offer ends, or is amended or withdrawn.

We reserve the right to offer in our complete discretion different customers different special offers, promotions and the ability to enter different competitions.

10. PRODUCT INFORMATION & ALERGY ADVICE

Product information, dietary flags, photographs, and pack sizes are all for illustrative purposes and general advice. Though we believe them to be correct they cannot be guaranteed. From time to time recipes, packaging, dietary classifications and ingredients vary and change and we may not always be as up to date as we would like to be, so please always check the details on the packaging before using. This is especially important if there is a possibility of an allergic reaction.

Please contact the manufacturer of the goods, or your own doctor directly if you have any doubts concerning the nature of product ingredients or if you suspect that you may be allergic to the ingredients.

Nut Caution: Please note that we store nuts on our premises along with all other products, we do not have a special nut free zone.

11. REVIEWS

Reviews are a good way to give information from those familiar with a product or diet to those who may not have tried the product or who are new to a particular type of diet. So go ahead and tell others just how you use a product and what works for you. Top tips and your favourite recipes are always appreciated.

By submitting a review to our site you are agreeing to our use of it on our website under the following conditions:

  1. We reserve the right to edit your review as necessary to make it clear, grammatically correct and helpful to other users etc. We would not alter the essence of your review.
  2. We may decide not to publish your review. This would be at our discretion.
  3. You may submit up to ten (10) reviews/recipes per month.
  4. By submitting your review you are declaring that:
    1. You own and/or control the content of your review(s) and it is your own original work, not plagiarized in any way.
    2. The content is not defamatory and does not infringe any applicable laws.
    3. The content is not a duplicate of a previous review/recipe or part thereof.
    4. That the content is, in your view, accurate, truthful and reflects your true and honest opinion of and current experience with a product you have purchased from us and which you are reviewing.

Reviews and Content Guidelines

You agree to post reviews and contributions in accordance with the following Guidelines.

  • Reviews should not contain words, language or content that is or may be considered unlawful, defamatory, libellous, abusive, racially or sexually offensive or obscene.
  • Reviews should not contain just a single word, and should neither be overly lengthy. An ideal length would be over 30 words and under 200 words.
  • Reviews should not contain advertising/spamming or links to commercial websites or email addresses connected to same. Neither shall it contain any advertising or alternative product prices.
  • Reviews should be genuine experiences of products purchased on our website, and content should be relevant and helpful to other users of the website.
  • Contributors under the age of 18 should get the permission of a parent or guardian before submitting any review.
  • Due to the nature of our products, ingredients often are altered by suppliers to improve texture and taste. Therefore we can only except reviews of products brought from us in the last 3 months. Older reviews may no longer be a true reflection of the current product.

12. INTERNATIONAL ACCESS

GoodnessDirect is not able to guarantee that any product or content on GoodnessDirect.co.uk is appropriate or available for use in locations outside the UK and accessing GoodnessDirect.co.uk from territories where its content is illegal or unlawful is prohibited. If you choose to access the GoodnessDirect.co.uk and/or order from it from locations outside the UK you do so on your own initiative and risk and are responsible for compliance with local laws and import duties or taxes.

13. GENERAL

If any of these Terms & Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms & Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us or our licensors. You are permitted to use the material data and content only for your personal use in placing orders through GoodnessDirect.co.uk, and you may not otherwise copy, reproduce, transmit, publish, display, distribute, commercially exploit, use or create derivative works of any material data and content on the GoodnessDirect.co.uk website without our prior written permission. We may impose a fee on any proposed use of the material data and content contained on its website, other than for placing orders through the GoodnessDirect.co.uk website.

These Terms & Conditions will be governed by English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise between them.
